Notes on executing a will

  1. Download a free will template here.

  2. A will must be signed at the end of the document, not necessarily the bottom of the page. This means that you must not leave a blank space between the last paragraph of the will and the signature.

  3. Each page of the will must be signed by the testator.

  4. The testator must sign the will (or confirm their signature) in the presence of two witnesses who are not mentioned in the will.

  5. The witnesses must be 14 years of age or older, and competent to give evidence in a court of law.

  6. The witnesses must sign the document in the testator’s and each other’s presence.

  7. The witnesses need not read the whole document – they are only confirming that the document was signed by the testator.

  8. If you have any doubts or queries, please contact Duncan for friendly advice.
